Terms of Service

Please read these Terms of Service carefully before using DrawMe. By downloading, installing, or using our application or website, you agree to be bound by these terms. If you do not agree to these terms, do not use DrawMe.

1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and DrawMe ("we", "us", or "our") governing your access to and use of the DrawMe mobile application, website, and related services (collectively, the "Service").

By creating an account, joining the waitlist, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated into these Terms by reference.

2 Description of Service

DrawMe is a mobile application that analyses historical New Zealand Lotto and Powerball draw data to generate number combinations using statistical methods including frequency analysis, hot/cold number trends, pattern recognition, and ensemble modelling.

The Service includes:

  • Statistical number generation using multiple prediction strategies
  • Historical NZ Lotto and Powerball draw results and analysis
  • Frequency statistics, hot/cold number tracking, and smart insights
  • Ability to save, rate, and track favourite number combinations
  • Starter (no cost) and Premium subscription tiers

3 Important Disclaimer

⚠️ DrawMe is a statistical analysis and entertainment tool only. It does not predict, guarantee, or improve your chances of winning any lottery draw. All lottery draws are random events. Past draw patterns do not determine or influence future outcomes.

By using DrawMe, you explicitly acknowledge and agree that:

  • DrawMe does not guarantee any lottery winnings whatsoever
  • The numbers generated by DrawMe have the same statistical probability of winning as any other randomly selected combination
  • Any "confidence scores" shown in the app are mathematical indicators of how a combination aligns with historical patterns — they are not predictors of future outcomes
  • Lottery gambling involves financial risk. You should only spend what you can comfortably afford to lose
  • DrawMe is not responsible for any financial losses incurred from acting on numbers generated by this app

4 Eligibility

To use DrawMe, you must:

  • Be at least 18 years of age, or the minimum legal age for lottery participation in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under any applicable law

By using DrawMe, you represent and warrant that you meet all of the above eligibility requirements. DrawMe reserves the right to terminate accounts of users who do not meet these requirements.

5 User Accounts

Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@drawme.app if you become aware of any unauthorised use of your account.

One Account Per User

You may only create one account per person. Creating multiple accounts to circumvent usage limits or to abuse early access offers is prohibited and may result in all accounts being terminated.

6 Subscriptions & Billing

Subscription Tiers

DrawMe offers a Starter tier at no cost with limited features, and a Premium tier with full access. Premium is available on a monthly ($4.99 NZD/month) or annual ($39.99 NZD/year) basis.

Billing & Renewals

Premium subscriptions are billed in advance and automatically renew at the end of each billing period unless cancelled. Subscription management and payments are handled by RevenueCat and processed through Apple App Store or Google Play Store, subject to their respective terms.

Cancellation

You may cancel your Premium subscription at any time through your device's app store subscription settings. Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused subscription time, except where required by New Zealand consumer law.

Refunds

Refund requests are subject to the refund policies of the Apple App Store and Google Play Store. We will work with you in good faith to resolve any billing issues. Contact us at hello@drawme.app if you have a billing concern.

Price Changes

We reserve the right to modify subscription pricing. We will provide at least 30 days' notice before any price change takes effect for existing subscribers.

7 Early Access Offer

DrawMe offers the first 500 users who join the waitlist 60 days of Premium access on us upon the app's launch. The following conditions apply to this offer:

  • The offer is limited to the first 500 verified waitlist registrations, determined by the order in which email addresses are recorded in our database
  • Each email address is eligible for this offer only once
  • The 60-day period begins on the date your account is activated at launch
  • No credit card or payment information is required to redeem the offer
  • After the 60-day period, your account will revert to the Starter tier unless you choose to subscribe to Premium
  • DrawMe reserves the right to modify or withdraw this offer at any time before launch, with reasonable notice to affected waitlist members
  • This offer has no cash value and cannot be transferred, exchanged, or combined with other offers

8 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to violate any applicable New Zealand or international law or regulation
  • Attempt to reverse engineer, decompile, or disassemble any part of the DrawMe application
  • Attempt to gain unauthorised access to our systems, databases, or other users' accounts
  • Use automated tools, bots, or scripts to scrape data or generate excessive numbers of predictions
  • Misrepresent the predictive capability of DrawMe to others in a way that could cause harm
  • Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure
  • Reproduce, duplicate, or sell any part of the Service without express written permission from DrawMe

9 Intellectual Property

All content, features, and functionality of the DrawMe Service — including but not limited to the application code, design, graphics, text, algorithms, and data compilations — are owned by DrawMe and are protected by New Zealand and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use in accordance with these Terms. You retain ownership of any data you personally input into the Service (such as favourite names or notes), but grant us a limited licence to store and process that data to provide the Service.

Historical NZ Lotto draw result data is used for analytical purposes. DrawMe claims no intellectual property rights over the underlying draw result data itself.

10 Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure at all times
  • Any information provided through the Service is accurate, complete, or current
  • The Service will meet your specific requirements or expectations
  • Any defects in the Service will be corrected within any particular timeframe

Nothing in these Terms excludes any consumer guarantees you may have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.

11 Limitation of Liability

To the maximum extent permitted by New Zealand law, DrawMe and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or goodwill
  • Any financial losses from lottery participation based on numbers generated by our Service
  • Service interruptions or data loss
  • Any damages arising from unauthorised access to your account

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount you have paid to DrawMe in the twelve months preceding the claim, or $10 NZD, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded under New Zealand law.

12 Termination

Termination by You

You may terminate your account at any time by contacting us at hello@drawme.app or through the account deletion option in the app's settings. Upon termination, your right to use the Service ceases immediately.

Termination by Us

We reserve the right to suspend or terminate your account immediately, without notice or liability, if we determine that you have breached these Terms, engaged in fraudulent activity, or if we reasonably believe your use of the Service poses a risk to other users or our infrastructure.

Effect of Termination

Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, and limitations of liability. We will delete or anonymise your personal data in accordance with our Privacy Policy.

13 Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. You agree to submit to the exclusive jurisdiction of the New Zealand courts for the resolution of any disputes arising under or in connection with these Terms.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

14 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending you an email notification or displaying a notice within the app.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
